I DONTCARE!!!

Little children are dying in Israel and Palestine. Education in this country is a joke. Immigrantion is a mess. I could care less if this guy lost his job for, buying weed. Maybe he should move to a state where it's legal. I'm sure he could get a job as a security guard in Colorado. Some of those marijuana retail store's have more than one security guard.

You sound like you must be a pot user yourself. The companyhe worked for was 100% in the right. He signed an agreement and broke it. It has NOTHING to do with legality. Alcohol is legal but an employer has the right to fire someone for using it on the job or while under the influence of it.
I must have missed something. I thought he was fired for purchasing weed in a state that the purchase of weed is legal. I didn't realize he was fired for being under the influence of it at work.
 
so what if he did? that's when they were illegal. maybe he didn't just want to be one of the first buyers, maybe he wanted to be the first to stand up for his rights to do as he pleases on his time.
now he can go to court and get an explanation from the courts as to why his employers rights are more important than his rights.

this country was supposed to be about human rights, it seems to me these days it's more about corporate rights.

why should a business controll your life by controlling your liberty by limiting your pursuit of happiness when it harms no-one?

besides, security jobs aren't that hard to get. he'll probably get a job offer or two from pro-pot bosses just from the publicity.

When you work in certain industries and services your employer has the right to expect a certain level of behavior. I have worked many jobs that required me taking the WHIZZ QUIZ. You had to disclose all of the medications and supplements you take and certain supplements were barred from use even though they were legal. They could mask illegal drug use. If the Security Guard carries a firearm and he gets busted his career is over. Felon for life.

In the grand scheme of things this is really just a minor issue. A person underestimates his employers commitment to a drug free work place and gets canned. I'm more concerned about all of the young kids being transported through the Central America by Coyotes and dumped in sex trade or abandoned if they get sick.

No that is not the issue. A condition of his employment stated that he not have any drugs in his system while on duty. After getting his 15 minutes of fame on television he was asked to submit to a urine test. This test was positive for drugs in his system hence he was fired. Now if the idiot had not strived for the almighty position of being the first he would not have been found out by his employer to be a user and likely would never have been asked to submit to a urine test.

You must be another pot smoker too. What RIGHTS are you talking about? Should someone have the RIGHT to get stoned while at work especially if he is in a security position and carrying a gun? Should the employer not have the RIGHT to fire someone working under the influence of drugs or alcohol? What about the RIGHTS of the company that he is supplying security for? The issue at hand is NOT what he was doing on his own time but rather the fact that he failed a urine test on company time. He had drugs in his system which was a violation of his employment.

we have a no drugs or alcohol policy at work which I am sure pretty much all places have as well. AFAIK nobody has ever been asked to submit except in the very few cases where someone was hurt in an accident. In those cases it is mandatory to submit to a urine test to determine if alcohol or drugs were a factor in the accident. That is their right to do. It is their insurance plan that takes a hit when someone is injured on the job.

Same as mine CK except we are asked to submit samples for testing, it is part of the requirement for the position, working with dangerous explosive chemicals.

I signed an agreement no drug or alcohol use at work, I also have to inform my employer of any prescription drugs I am prescribed.

Further more the STATES are legalizing the marijuana not the federal government, and until workman's comp and the employers insurance company says it is legal to use marijuana as a recreational drug any one with any common sense and who enjoys their salary from an employer should not use it.

actually, there is no state where the purchase is legal..... it may not be a violation of STATE law, but,........... that doesn't make it legal.
it IS a violation of FEDERAL law.

I'll give you an example, there is no specific state law that makes it illegal to murder a president.
there is a specific FEDERAL law that does make that a crime.




it works both ways.
in my state there are "dry" counties, even though state law allows the sale of alcohol, it is not legal to sell it in my county.....

there are plenty of people that drink a cup of coffee or soda too late, don't sleep well, and their job performance suffers. coffee should be illegal?
there are people whose personal life causes their work performance to suffer. sick children cause them to take time off, elderly parents cause worry and stress and decreased attention at work. should we outlaw the family, or just the emotions?
some people eat mexican food and it gives them gas, bloating with cramps, and diarrhea, all severe distractions to driving a motor vehicle which endangers everyone on the road..

everything we do interacts with everything else. you can't possibly make everything illegal because it's going to interfere with something else.

I didn't say anything about getting stoned at work, and the information I had at the time was simply that he had bought it and was fired as a consequence. I fully understand the need for sober employees, end the employer should be able to fire someone for being intoxicated at work.
However...
depending on the type of test, it's entirely possible he was not intoxicated at work and should not have been fired for doing something that shouldn't have been illegal in the first place.

While I have smoked in the past, it's been many years since I have.

The right I'm talking about is the right to do what I please with my own body, and whether or not I partake in it is irrelevant to my reasoning. I'm in favor of decriminalization of many things that are simply a persons choice to do what they want with their own bodies.
at the same time I think there are many things that go on daily that should be severely curtailed. things that are allowed that cause damage to billions of people, plants, animals, and the air, water and habitat that we all need to survive.

Okay, Space Cowboy, I'll bite: yes, he has the "right" to do whatever he wants to his own body (the government isn't going to come in and snatch him away). However, if what he does violates some policy that he signed an agreement not to do with his employer, then his employer has the "right" to say, "Nice knowing you, now goodbye."

Was that easy enough?

He was under agreement with his employer to not use drugs while working for that company (not ever, not just while on duty). He violated that agreement. He was rightfully fired. Why is this so hard for you to understand (other than you're probably under the influence of the same product)?

was what easy enough? the fact that he can't do what he wants with his own body or the fact you either don't comprehend that or the restrictions fit your belief system so you assume no one should want to violate those laws?
the government locks up millions of people for violating their idea of morality. for doing things that harm no-one at the least or at the most the people harmed are the people violating those laws. at the same time companies get away with poisoning us with chemicals that are illegal in many other countries for their known toxicity.

so there's a contract. there were contracts issued to slave owners that all progeny of the purchased slaves were the purchasing families property in perpetuity.
you think those offspring should remain property? after all, they have a contract.

if a contract is illegal it is invalid. for an employer to tell someone what they can do while the employer is NOT paying them has negated contracts before. I myself was part of a lawsuit that invalidated our contract for trying to control our lives outside of work.
