When you get a ham license you are saying it is ok for you to as a natural person to be in contract with the fcc. As everything is in this country, we are the ones that agree to things . It is constitutional. Shall we look at section 10 clause 1 of the US Constitution. ..........." oh boy whoever put that in there, knew what would happen in this country because without the contract clause we probably would not be in the shape we are in, that and the general welfare clause which has been abused , I might add. But I digress. The FCC which is a sub corporation for the us government must make contracts to exist. This gives them power. Without the consent of you, the people, they have no power. They may act like they have power and they may do things that are illegal and unlawful but does this make them right? No. So I say do not get a ham license , and if you must know just about any license you get is a contract and when you sign it , you are saying that it is ok for the government entity you are making contract with, to have power over you. The dirty little secret about this dirty country is that we are the ones that make it happen, whether it is good or bad. We are the ones that are responsible. We cannot point fingers at anyone but ourselves. We get angry at what happens and then you must know that we are ones that are responsible for it. It is all voluntary. Now that being said , you must know that law as we know it now, is colorable, which means it looks like law but is not. Therefore do not expect them to act according to common law. They will not. You are on your own under this system that we have but if you know how to act and know how to talk to them in the language that they know, then you will do ok............

FCC is a regulatory agency created by OUR representative government--CONGRESS!! The Act that created it was the Communications Act of 1934.

Now, just because you didn't "sign" something (and I am assuming we are talking about CB Radio) doesn't mean that in some way we can escape enforcement of Congressionally passed laws or regulations. If you read Part 95, it says that, by transmitting on a CB radio, you are agreeing to obey all the rules.

There is no reason to not obtain the Amateur license. You are not giving up any "rights" by doing so. In exchange for abiding by, IMHO, liberal rules, one gets thousands of 'channels', plenty of power, and far more than CB could hope to offer. The only who suffers is the fellow that thinks that there is some sort of conspiratorial repression of one's radio usage, or thinks that he is somehow exempt from the rules because he didn't 'sign' something. Remember: using a radio has NOTHING to do with one's "rights"--you have NO right to talk on a radio. It is a privilege granted by our Representatives. And said privilege is governed by Congress THRU FCC.

As far as the jamming, it is well rumored not documented.So far as I know there has not one ham come forward to confirm the rumor.It was placed on many blogs and consperacy sights. But I did find some responses to the rumor-

So, find a ham, and use ham skills to pin this down.. but without real names showing qualification to accurately describe the problem, I’d avoid the conspiracy theories.

I haven’t heard it, but what frequencies is it reported on? HF? Could also be Broadband over Power Lines or a damaged power transformer. I’ve been listening to the scanner feeds of air rescue traffic and the State Police/ national guard 800 system and it sounds fine. There’s not enough of it, but what’s there seems to work. "

About the so-called jamming in New Orleans: According to what I read on this site, it is apparently coming from a Navy ship. Most likely this alleged jamming is nothing but the air search radar of that ship, being used to track and control the flight of the helicopters that are delivering supplies. It is well known that such high-power radar systems have a lot of bleedover into other EM bands. Did you watch CNN a few days ago and see the live broadcast from the news chopper that the photographer Alpaugh was sending? He was showing a Navy ship docked in New Orleans and the radar of that ship was active. Every time the radar beam swept across the helicopter Alpaugh was in, you could hear an audible “thwip” noise on the audio feed he was sending. Alpaugh himself commented on being able to hear it in his headset. "

The very active sunspot region that caused a massive X-17 flare on 7-Sept has continued to affect HF communications with the Katrina affected areas. On 8-Sept this region produced another HF radio backout of shorter duration when an X-5 flare erupted at 2106 UTC 8-Sept. There was another X-1 flare at 0330 UTC 9-Sept. And an X-3 flare at 1000 UTC 9-Sept. More information about these flares can be found on SpaceWeather.com's web page. This very active solar region was just coming into view on the edge of the sun when the X-17 flare occured. As this region moves across the face of the sun during the next week to 10 days the chances are good that we will have more solar flares. NOAA forecasters say there's a 50% chance of more X-flares during the next 24 hours, possibly causing radio blackouts and radiation storms.

The West Gulf ARES net will be shutting down net operations at 0600 UTC 10-Sept.

Update - 3:30pm(CDT) 7-Sept-2005
There was a very strong X Class solar flare at 1740 UTC that caused a HF radio blackout. Three hours later the HF bands are still affected. This radio blackout has slowed and in many cases blocked HF communications with the Katrina affected areas. Propagation is returning slowly and should improve with time.

EXcellent post, Sonwatcher!~ I monitored quite a bit of traffic on HF and never heard any "jamming". I am continually amazed at the number of people who are absolute paranoid in almost everything they do. GASP! There's a conspiracy lurking around very corner. AAAAAAAAAAAAAAAAAAAAAACK! SAVE ME, SAVE ME for that mean old Gub'ment that's fixin' to take all my rah'ts!!!!!!!!!!!! IF they had ever WANTEd to do that, it would've already BEEN done! Like in WWII when much of life was regulated (such as gas rationing). As soon as the war was over, the restrictions and "nationalization" (if you want to call it that) was lifted.

And, no, I DON'T receive a socialistic insecurity check, I didn't pay INTO it, and won't ever collect a cent FROM it. What I DO get/will get is more than 2 1/2 times anything SSI would've paid! (maybe that's another 'conspiracy'!!!!!!! )

It is an un comfirmed rumor that is said to have started on one of the conspiracy websites and took off like a rocket. There have been no Hams say this is true. The fact is when the Ham community was telling about the solar flares causing "blackouts" the conspiracy websites and blogs just brushed it off.Also the point you made using the Constitution about contracts was a clause that was injected to protect the honoring of contracts between CITIZENS.If you look up legal disputes at the time you will see case studies where an individual from one state was having legal problems getting an individual from another state to honor their contracts because of different laws in both states.It is then that the protection to the citizen was honored by entering this clause to be followed by the state and federal governments. You are quick to personally attack those that find discrepancies in your "facts" that you use to prove your theories.I think your fear of Government has caused you to accept anything you hear that points to Gov. conspiacy as fact without investigating further outside the sources that you are reading these things.It is so strong that you resort to personal attacks with anyone that shares a different set of opinions or evidences contrary to what you post. I may be wrong but I thought the purpose of amateur radio licensing was just to make people aware of the dangers of RF and how to use equipment safely. The license itsel to me is nothing more than a certificate showing you have studied and you have a basic understanding?

OK, if *I* am a "gramps", then I lived in the best times the USA will ever see. I lived thru the Cuban Missile Crisis in October, 1962. I went to grammer school when it was grade 1 thru 8, only seeing entering a "Jr. High" school as a result of a move. I lived in a time when we had Chapel programs in the schools. We didn't have drugs in school, never heard of such a thing. A "Coke" was a soft drink we were only allowed to have maybe once a week if THAT. It cost 6 cents and came in a 6 ounce green bottle. Many of our secondary roads were dirt, and, mostly in the fall, our school bus would get stuck in the mud. My Dad bought gas for 14.9 cents per gallon and we took a pickup truck to town and filled up two 50 gallon drums for $14.90. He built a frame out in the barn and got a tractor boom to lift the drums onto this frame. Our four-eyed bureaucrats in EPA would have a coronary today, but those drums ran Dad's '58 Ford for MONTHS without ever having to visit a filling station. We had never heard of a student slapping a teacher in those days, and our principal had a 2 foot long paddle 3/8" thick that warmed many a butt who got out line. Nowadays I read where a teacher pepper-sprayed a student, a principal TAZERED one, and another got tazered by a cop. HOW DARE a teacher try to TEACH anything in a school and how DARE he defend himself against a physical attack by some middle school punk.

We did without air conditioning, grew most of our own vegetables, drove school busses at the age of 16 for the huge pay of $30 per month. And you know what? Our state in those days had one of the best driving and safety records in the nation. GASP!!!!!!!!!!!!!!!!!!!!! Sixteen year olds driving school busses?????????????? It happened because parents taught responsibility at an early age; we HAD to to keep up the farm and everybody contributed. In high school, we didn't get a car as a rite of passage at 16 and you were lucky to GET the family car (or pickup to go out one or two Saturday nights a month. Now the kids' cars won't START unless there's a cellphone stuck in their ears!~ :shock: We were fresh out of WWII, the memory still fresh in our parents minds and they never let us forget it, either. You were in church Sunday morning AND, if you were a

Mustang came on the scene and in 1966, the year I graduated, you could drive out off lot with a NEW Mustang Convertible with 289 V8 and 4 on the floor for around $2900. An SS 396 Chevelle could be had for not much more. The Chevy was the most popular because you could take a small-block Chevy engine in its most basic form, bolt on some heads, dual exhausts, a 60 CFM carb--all for around a hundred bucks--and blow a Ford into the weeds any day of the week. To achieve the same performance for a Ford took hundreds of dollars because their engines were not interchangible like the Chevy, and Yessir, we had FUN, Fun, Fun, till Daddy took the T-Bird Away.
