You use to have the choice,give it to them and fine would be less.Or wait till ya get the letter in the mail.At least thats what they did in 91 in my area.
Dont think so.They cleaned house back in 1991 and early 92 in my area.And took the equipment in lue of fines.Ine was on 27.425lsb and pulled in his drive way,and said take it.After he was told if he wanted it,he had to pay the fine.It might be dif now.But old Rob Ramage now KC enforcement head was the one that got him.If you have a license or are engaging in an activity that requires a license, you can be fined without a warning. In any other case, you must get a written warning first and then repeat the activity. I have only seem them ask people to give them amps, never radios. If you give them your equipment, you will still get either a fine or a written warning. Only exception is if the agent likes the equipment and keeps it for himself and doesn't write up a report.

Yep. Pretty much spells it out that they don't have authority to enter your home or vehicle under the constitution, but do have the right to check your equipment. If you refuse to let them in to check the equipment and you have an amateur license, they can fine you without any further action.
If you don't have a license and aren't engaging in an activity for which you need a license, then they have to give you a written citation with 30 days to respond. After the 30 days, they can again ask to check your equipment. If you haven't remedied the situation in those 30 days, well there's not a lot to say about that.
If any of the users get cited for amps, there's not a lot I can do for you. If you get cited for transceivers, I might be able to help. By the way, a lot of the field agents have never used a CB radio in their life. They go off that old list of names the judge said they couldn't rely on. I just had a guy call me two weeks ago because the FCC was telling him his Galaxy 979 was illegal because it wasn't certified.
So they might be using 2 numbers for 10 meter and 3 numbers for CB.
