US District Court Judge Rules Against California’s Unconstitutional Gun “Law”

On Friday, a US District Court Judge ruled that California’s new “law” that bans high-capacity gun magazines is “unconstitutional in its entirety.” Of course, this is no surprise to those who actually believe the words of the US Constitution’s Bill of Rights and the Second Amendment, as well as the clear limitations of government to infringe in any way on the rights of the citizens to keep and bear arms of all kinds, including accessories that are used in conjunction with those arms.

“Individual liberty and freedom,” said US District Court Judge Roger Benitez, “are not outmoded concepts. This decision is a freedom calculus decided long ago by Colonists who cherished individual freedom more than the subservient security of a British ruler. The freedom they fought for was not free of cost then, and it is not free now.”

The ruling forbids California Attorney General Xavier Becerra from enforcing the state’s unconstitutional pretended legislation that does not allow for magazines that hold more than ten rounds.

“California’s law prohibiting acquisition and possession of magazines able to hold any more than 10 rounds places a severe restriction on the core right of self-defense of the home such that it amounts to a destruction of the right and is unconstitutional under any level of scrutiny,” he wrote in an 86-page decision.

That was a couple weeks ago. The stay has been overturned and as of the 5th it is illegal to purchase any magazine over 10 rounds again. They made sure to include a provision that any mags purchased would be considered legal and people would be safe having and using them.

Yeah, no doubt. If it actually sticks in the SCOTUS that this is unconstitutional (as it should) most of the politicians in this god forsaken state heads will pop all at once.

But then those politicians can't protect you from yourselves. According to all the socialists running the State Of Kaliforian, only they can make the best decisions for you and provide a nanny state to komfort and nurture all to be good little socialists who share all their wealth, get taxed to death, and hold hands singing songs about the great land of fruits and nuts.

Just read where Cali has added .12 cents gas tax and another due mid summer of 5.6 cents per gallon to improve failing roads and infrastructure, which it is obvious they have already deferred the monies to fulfill the handouts to illegals. The failed high speed rail system....well.....another story of mismanagement to get federal dollars. Cali is leading all these other states down the road of socialism via proposed removal of the electoral college. Very unconstitutional.

I hope the judge rules in favor of 2nd, it may just be the downfall for democratic socialist movement and save us from SHTF, which will probably start on the left coast due to the volatile instability created by unsustainable economics.

And they just instituted a $.25 a gal gas tax last year along with an increase on our vehicle registrations.Tax and spend. They have this idea that because of all of the big tech money here that the people can afford it. And Newsome having come from San Francisco I think he really and truly believes that.

Politicians are fickle, Texas repub house took constitutional carry off the floor because McNutt from Tx Gun Rights was making house calls to push for constitutional carry in Texas. The proposition had stalled and McNutt figured if politicians could go to your house and ask for votes based on promises for constitutional carry, the public had the right to go to their house and request they follow through.

Don't think any of those politicians had any thought to actually follow through. Silly law down here......you have to have a concealed carry permit to open carry. Other states are open carry, some states are going to constitutional carry with concealed. Go figure.

I remember asking where I could get a good load of manure and they directed me to the Capitol in Austin, TX. The individual told me there is more manure there than any garden could ever hold.

Ya know, with the clowns to left of me, and jokers to right......I do see promise and not just dooms day SHTF........with leftist so unhinged I'm reading where they are not finding anyone in the middle by showing how radical they are. Also noticing a full circle of exposure coming back to haunt them. To me the worst cheats are on the left, the worst sexual predators are on the left, the worst frauds are on the left and they are getting exposed by their own makings.

Unfortunately they seem to want to take everything down with them. Almost Biblical, Sodom and Gomorrah, and we have to endure by playing nice and allowing twisting of laws, rules and The Constitution of the United States. Should we call these Red Flag Laws into question we are the evil ones for even questioning the legitimacy, when they weren't even legitimate to begin with.
